Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the services provided by National Scouting Bureau ("NSB," "we," "our," or "us"), including athlete evaluations, scouting reports, recruiting support, Performance Combines, GameDay events, Hit-a-Thon fundraisers, and the Verified Prospect Program (collectively, the "Services").

By booking a service, submitting a form, attending an NSB event, or otherwise using the Services, you ("User," "Client," "Participant") agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Description of Services

NSB provides the following categories of services:

1.1 Individual Athlete Evaluations

Data-driven assessments of baseball athletes using professional measurement technology including Zybek timing, FlightScope XB3, Stalker Pro II radar, OVR jump mats, and grip dynamometers. Evaluations result in a written scouting report with verified performance metrics.

1.2 Performance Combines

Group evaluation events open to multiple athletes. Combines employ the same hardware suite as individual evaluations and provide a full athletic profile for each participant.

1.3 GameDay Events

Live competitive events where athletes are evaluated in game-context performance scenarios by NSB scouts.

1.4 Hit-a-Thon Fundraisers

Sponsored fundraising events for leagues, teams, and organizations. NSB manages event logistics, data collection, and athlete performance measurement on behalf of participating organizations.

1.5 Verified Prospect Program (VPP)

A premium, application-based managed recruiting service in which NSB scouts conduct direct outreach to college coaches on behalf of enrolled athletes, backed by verified data and professional video portfolios.

1.6 Website and Digital Tools

Access to NSB's booking platform, athlete profiles, and related digital tools available at scoutbureauos.polsia.app and associated domains.

2. Eligibility and User Obligations

2.1 Age Requirements

Athletes of any age may participate in NSB Services. However:

  • Users must be at least 18 years old to enter into binding agreements with NSB
  • For athletes under 18, a parent or legal guardian must complete all registration, consent, and payment steps
  • For athletes under 13, parental consent is required as described in our Privacy Policy (COPPA compliance)

2.2 Accurate Information

You agree to provide accurate, complete, and current information when registering or booking NSB Services. Providing false information (including falsified athletic data, fraudulent identities, or misrepresented eligibility) may result in immediate termination of Services without refund and possible legal action.

2.3 Conduct

All participants at NSB events must conduct themselves professionally and respectfully. NSB reserves the right to remove any participant from an event for disruptive, unsafe, or unsportsmanlike behavior without refund.

2.4 Health and Safety

By participating in NSB events, you confirm that the athlete is physically fit to participate in athletic testing. NSB is not responsible for injuries arising from pre-existing medical conditions. If an athlete has a medical condition that may be affected by strenuous physical activity, obtain physician clearance before participating.

3. Payment Terms

3.1 Service Pricing

Current standard pricing for NSB services is as follows (subject to change with notice):

Prices are listed in USD and are subject to change. Any price changes will not affect services already paid for.

3.2 Payment Processing

Payments are processed securely through Stripe. By completing payment, you authorize NSB to charge the applicable fee to your provided payment method. All transactions are subject to Stripe's terms of service.

3.3 Refunds

Individual evaluation bookings may be cancelled for a full refund if cancelled more than 48 hours before the scheduled evaluation. Cancellations within 48 hours of the evaluation are non-refundable unless the cancellation is initiated by NSB.

Event-based services (Combines, GameDays, Hit-a-Thons) are subject to event-specific cancellation terms communicated at time of booking.

VPP retainer fees are non-refundable once the monthly billing period has commenced.

3.4 Failed Payments

If a payment fails, services will be suspended until payment is resolved. NSB reserves the right to charge any outstanding balances upon resolution.

4. Intellectual Property

4.1 NSB Proprietary Content

NSB owns all rights to:

  • Evaluation methodology, scoring algorithms, and scouting frameworks
  • Scout reports, written analyses, and proprietary ratings
  • Website content, logos, trademarks, and brand assets
  • Event formats, training materials, and operational processes
  • Software tools and the NSB digital platform

You may not reproduce, distribute, modify, or commercially exploit NSB's proprietary content without express written permission.

4.2 Athlete Data and Content

Athletes retain ownership of their underlying performance data (raw metrics such as exit velocity, sprint time, etc.). However, by engaging NSB Services, you grant NSB a license to:

  • Use your performance data to generate scouting reports and athlete profiles
  • Share your profile and data with college coaches in connection with recruiting services you have purchased
  • Use anonymized or aggregated data for research, benchmarking, and service improvement
  • Feature athlete success stories and testimonials in NSB marketing materials (with athlete/guardian consent)

4.3 Video Content

Video footage captured or submitted in connection with NSB evaluations may be used within your athlete profile and shared with college coaches as part of your purchased service tier. Raw footage rights remain with the athlete/family; NSB retains a limited license for recruiting and service delivery purposes.

5. Limitation of Liability and Disclaimers

No Guarantee of Placement or Scholarships. NSB does not guarantee college placement, athletic scholarships, or any specific recruiting outcome. Our services improve visibility and verified data quality, but college admission and scholarship decisions are made solely by academic institutions and coaching staffs.

5.1 Service Disclaimer

NSB Services are provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of our evaluations, scouting reports, or recruiting services.

5.2 Limitation of Damages

To the maximum extent permitted by applicable law, NSB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of athletic opportunity, or loss of scholarship prospects, even if NSB has been advised of the possibility of such damages.

NSB's total liability for any claim arising from the Services shall not exceed the total fees paid by you to NSB in the 12 months preceding the claim.

5.3 Assumption of Risk

Participation in athletic testing, combines, and events involves inherent physical risk. By registering, you acknowledge and accept these risks. NSB is not liable for injuries that occur during NSB events when proper safety protocols have been followed.

6. Event Cancellation and Modification

NSB reserves the right to cancel, postpone, or modify any scheduled event (Combine, GameDay, Hit-a-Thon) due to:

  • Inclement weather or unsafe conditions
  • Insufficient participant registration
  • Venue unavailability or force majeure events
  • Equipment failure or personnel emergencies

In the event of a cancellation initiated by NSB, registered participants will receive either a full refund or the option to reschedule at no additional cost. NSB will notify participants as soon as reasonably practicable via the contact information provided at registration.

NSB is not liable for travel costs, accommodation expenses, or other costs incurred by participants in connection with a cancelled event.

7. Privacy

Your use of NSB Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in [County], [State] for the resolution of any disputes arising from these Terms.

9. Dispute Resolution

Before initiating any formal dispute, you agree to first contact NSB and provide a written description of the dispute. NSB will attempt to resolve the dispute informally within 30 days of receiving notice.

If the dispute cannot be resolved informally, the parties agree to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

Class Action Waiver: You agree to resolve disputes with NSB on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against NSB.

10. Indemnification

You agree to indemnify, defend, and hold harmless NSB, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any applicable law; or (d) false or inaccurate information you provided to NSB.

11. Modifications to Terms

NSB reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new effective date. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
